Automotive lawyer Smirnov named four ways to achieve additional payment under compulsory motor liability insurance

If the insurance payment under compulsory motor liability insurance is not enough to repair the car, the driver can prove this using several methods. Automotive lawyer Sergei Smirnov spoke about this in an interview with Motor magazine. The easiest way is to show the calculation from a car service center, he noted.

“If the insurance company pays money, and a person, having received it, goes to a car service center, and they tell him that, relatively speaking, 400 thousand are needed for repairs, and he only has 100 thousand rubles in compensation, then this will be confirmation, by and large, in order to file a claim with the insurance company,” the lawyer said.

Another option to claim the required amount if the car owner does not agree with the insurance payment is to conduct an independent examination. It is carried out according to a unified method for calculating damage, which is used by all insurers.

When the conclusion shows that the company underestimated the payment, the driver has grounds for a formal complaint. If the insurer refuses this time too, the next authority is the financial ombudsman. And only after refusal on his part can you go to court.
