Automotive lawyer Voropaev named three cases when the court will cancel the fine of the traffic police camera

Such a fine may be canceled if the violation is not confirmed or the device was not working properly. Automotive lawyer Lev Voropaev told Motor magazine about this in detail.

“The court will cancel the fine issued by the photo-video recording camera if it is reliably established that there was in fact no violation of traffic rules. It is the absence of an offense that is the main and unconditional basis for canceling the decision,” the lawyer said.

According to him, another basis for canceling the fine is if the car at the time of the violation was in the possession of another person (for example, it was not driven by the owner, but by a driver by proxy, a renter, etc.).

In this case, the owner needs to contact the traffic police or a higher official together with the actual driver before the statute of limitations expires and confirm that he was not the one driving. If the department refuses to cancel the decision, then upon subsequent appeal to the court, the fine will be canceled.

Also, the reason for canceling the fine may be the expiration of the verification period for the measuring device with which the camera recorded the violation.
