“If a pedestrian crossed a zebra crossing at the same time as a car, it is possible to challenge such a fine only if the front of the car has already crossed the pedestrian crossing. If the car did not arrive, but the pedestrian entered, or at that moment the front of the car entered the pedestrian crossing, then in this situation the courts clearly say that the driver is obliged to give way to the pedestrian,” said the lawyer.
According to him, if the transport body has passed, and at that moment the pedestrian has just entered the pedestrian crossing, then you can fight for the cancellation of the fine.
Most often, the punishment is canceled when it turns out that the person was already walking in the direction of the car, that is, his trajectory and the position of the car at the moment did not intersect on this section of the road.
In this case, this is a 100% basis for canceling the fine, the lawyer assured.
