It is more difficult to terminate a car purchase and sale agreement after registration with the traffic police if the seller is an individual rather than a legal entity. Automotive lawyer Lev Voropaev told Gazeta.Ru about this.
“Registration with the traffic police is only a registration of a vehicle, and not a confirmation of ownership. According to the law, ownership rights arise from the moment the purchase and sale agreement is signed and the actual transfer of the car to the buyer. If a car was purchased from a legal entity, the law provides grounds for terminating the contract and returning the money paid for the car,” the lawyer noted.
Voropaev clarified that the basis for termination could be, for example, a significant defect in the car or the discovery of any defect within 15 days from the date of purchase of a new car. In these cases, the buyer has the right to send a claim to the seller-legal entity and terminate the contract with a refund of the amount paid.
The situation is more complicated with used cars purchased from private individuals: it is much more difficult to terminate the contract and return the money, and sometimes it is completely impossible.
