At the same time, according to the Russian Family Code, a car purchased during an official marriage with the joint funds of the spouses is recognized as jointly acquired property and is subject to division upon divorce – although it does not matter which spouse it is registered in the name of.
By law, the shares of spouses in jointly acquired property are recognized as equal, unless otherwise established by the marriage contract or division agreement. The car itself, as an indivisible thing, according to the law, cannot be physically divided, so its fate had to be determined by the court – it should be transferred to one of the spouses, and the second should be awarded monetary compensation in the amount of half the market value of the car.
