In Russia, cases of confiscation of the machine for traffic violations have become more frequent

Since July 2022, an article has been operating in Russia to confiscate Russians cars for repeated gross violations of the Rules of the road. Since then, the number of confiscation is growing rapidly, Kommersant notes, referring to judicial statistics. In the second half of 2022, 614 cars were seized in favor of the state, for 2023-more than nine thousand, and almost six thousand for the first half of 2024.

The Criminal Code implies the confiscation of cars for re -driving, intoxicated, without rights, as well as for multiple exits to the oncoming lane or significant speed excess. According to Kommersant, most often the cars of drunk drivers turn to state property.

Moreover, often the car is confiscated as an instrument of crime, even if it does not belong to the violator.

So, the Constitutional Court considered a complaint of a resident of the Kursk region, from whom a car was seized for a “drunken” ride. The defendant of the case complained that the verdict did not take into account his obligations to the third parties – the car was in the pledge of the MFI. In the Constitutional Court, they considered that the punishment was justified and “in proportion to the public danger of misconduct.”

Meanwhile, the Ministry of Internal Affairs is going to simplify the procedure for designing drunk drivers to optimize the work of inspectors. Now they are obliged to draw up from three to five procedural documents – for example, protocols on removal from management and detention of the vehicle.
