Deputies of the Russian State Duma rejected a bill that proposed to establish criminal liability for deliberately causing traffic accidents for the purpose of extorting money – the so-called auto frame-ups. Information about this was published on the official website of the lower house of parliament.
The initiative intended to make car fraud a separate crime. The authors of the bill proposed punishing the perpetrators with imprisonment for up to four years, and if the crime was committed by a group of persons by prior conspiracy or caused serious harm to the health of the victim – up to seven years. According to the developers, such measures correspond to the sanctions provided for fraud and extortion.
However, the relevant State Duma Committee on State Building and Legislation gave a negative opinion. In its response to the bill, the committee indicated that crimes against traffic safety and transport operation are already covered by existing articles of the Criminal Code, in particular Article 27 of the Criminal Code of the Russian Federation.
In addition, the conclusion notes: the reference in the draft to extortion as the purpose of creating an accident without the presence of the signs listed in Part 1 of Article 163 of the Criminal Code of the Russian Federation (extortion) is not enough to classify such an act as a crime against property.
