Automotive lawyer Smirnov: navigator data will help cancel a fine from a camera

It is possible to challenge a fine from an automatic recording camera, but it is almost impossible to prove a software failure. Automotive lawyer Sergei Smirnov spoke about this in an interview with Motor magazine.

“If we are talking about automatic recording cameras, the only way to challenge the decision is to file a complaint with the organization servicing this camera. They are required to carry out technical verification of the equipment and confirm its serviceability. However, it is almost impossible to prove a software failure, except to cast doubt on the very event of the violation,” the lawyer said.

According to him, an example would be a situation where a car owner has data from a car navigator that records driving speed. This data may become one of the grounds for a court or official to cancel the decision. However, technical failures of cameras are a difficult topic to challenge decisions.
